Chumba Casino Parent, VGW, Wins Georgia Lawsuit Against Class Action Filers

This week we have an update on a class action lawsuit they have been defending in the State of Georgia.

Editor's Note: It's always big news when sweepstakes casino industry titan VGW, the parent company of the juggernaut Chumba Casino, finds itself in litigation. In such cases, we feel compelled to report on it in our role as industry watchdogs. However, for various reasons, we do not recommend that US players play at Chumba Casino. We elaborate on this at the end of the article.
Each week it seems like more and more states are threatening sweepstakes casino actors with regulation, legislation and/or enforcement.
Additionally, class action lawyers have been advertising aggressively on social media to build cases challenging online sweeps casinos' advertising practices. That was the case in Georgia, as once again, industry titan VGW, the parent company of sweeps casinos Chumba, Luckyland Slots and Global Poker, was involved once again in class action litigation.
Earlier this month, one of the cases involving VGW was brought to a close, as Judge Thomas Thrash of the US District Court for the Northern District of Georgia granted a motion by VGW to dismiss the class action lawsuit brought by plaintiff Destiny Kennedy.
Judge Thrash agreed that Kennedy, who filed the suit at the outset in state court last year, never opted out of the updated VGW arbitration clause. Kennedy's attorneys made a motion to amend, but Judge Thrash denied the request and decertified the class, bringing the case to an end.
Additionally, VGW claimed that the court lacked jurisdiction in the case, as VGW does not intentionally market specifically to residents of Georgia.
Judge Thrash agreed with that claim and mentioned the question of jurisdiction as his primary basis for dismissing the case.
The ruling in the Kennedy case marks the third time VGW has prevailed in a lawsuit in the Peach State.
Although the casinos under the VGW umbrella (Chumba Casino, Luckyland Slots and Global Poker) are indeed reputable US casinos, we here at SportsBoom have elected not to recommend them to our readers.
